On August 28, 2012 Capstick was arrested at the Cumberland County courthouse on charges that he intentionally set a fire on June 28, 2012 at his residence in the 1100 block of Floribunda Lane, Mechanicsburg. Police had responded to the residence on an unrelated matter, but when officers arrived fire was observed inside the residence. The Upper Allen Township Fire Department as well as other fire departments responded to extinguish the blaze. Capstick was the only occupant of the residence at the time of the fire. A subsequent investigation determined the fire was inconsistent with an accident.
Capstick was arraigned by Magisterial District Judge Paul Fegley and committed to the Cumberland County Prison in lieu of $2,500 bail. A preliminary hearing has been scheduled for October 8, 2012 before Magisterial District Judge Donald Howell.
