During October 2009 Daly wrote five checks in excess of $10,000 and deposited them in a a new account he opened at a local bank. The checks were returned after Daly withdrew a portion of the funds. A warrant was obtained and Daly was arrested on January 14, 2010. Daly was arraigned before District Judge Mark Martin and released on $10,000 bail. A preliminary hearing is scheduled for February 2010 before Judge Martin.
