In the early morning of March 17, 2012, Upper Allen Police stopped a vehicle on US Route 15 for a speeding violation. During the traffic stop, the odor of marijuana was evident. Officers impounded the car which was later searched. During the search several pieces of drug paraphernalia and a small amount of marijuana was found. Charges against Capozzoli were handled by summons. On June 18, 2012, Capozzoli appeared before Magisterial District Judge Martin and waived his preliminary hearing.
