On Friday June 22, 2012, Fernandez was arrested at his home in Penbrook following an investigation into two sexual assaults reported to Upper Allen Police. Fernandez is accused of having sexual relations with a 15 year-old girl and a 19 year-old mentally disabled woman, both of whom live in Upper Allen Township. The incidents are alleged to have occurred in April 2012 and were reported at that time. Fernandez formerly resided in Upper Allen Township and was an acquaintance of both girls.
Fernandez was arraigned before District Judge Elizabeth Beckley on June 23, 2012 at the Cumberland County Prison where he remains in lieu of $100,000 bail. A preliminary hearing on the case is scheduled before District Judge Mark Martin on July 2, 2012.
