Types of Fireworks
Pennsylvania law defines “consumer fireworks” as devices that produce a visible or audible effect by combustion. These include firecrackers, Roman candles, bottle rockets, and similar items. Where Can Consumer Fireworks Be Used?
Consumer fireworks can only be used on private property with the permission of the landowner. They cannot be used within 150 feet of a building or vehicle. Fireworks are also prohibited in parks, forests, and other public areas. It is strictly prohibited to discharge fireworks from or aim them at any building or vehicle.

When Can Consumer Fireworks Be Used?
Local municipalities have the authority to restrict the use of consumer fireworks between 10:00 PM and 10:00 AM. However, state law allows for extended use until 1:00 AM on the following dates:
- July 2nd, 3rd, and 4th
- December 31st
Additionally, if July 4th falls on a Tuesday, Wednesday, or Thursday, fireworks may be used until 1:00 AM on both the preceding and following Friday and Saturday.
Upper Allen Township Noise Ordinance
In Upper Allen Township, the discharge of consumer fireworks between 10:00 PM and 6:00 AM is considered a noise disturbance under local ordinance. However, this ordinance does not apply to the specific dates and times mentioned above where state law permits extended fireworks use.
